Terms of Agreement and Service

Please read the Terms of Agreement and Service carefully before you use or register on this Platform.

Whilst using Dietitian Health Hub (DHH) Platform and by registering your subscriptions, you disclose that you agree to the Terms of Agreement and Service set herein and acknowledge our Privacy Policy.

It is DHH policy that visitors on DHH Platform must be over 18 years old. Please do not use this Platform or DHH services if you are under the age of 18 years old. Providing your personal information whilst using DHH Platform states you are over 18 years old.

DHH will not review or verify the information provided by Dietitians to use DHH Platform. DHH relies on Dietitians to provide true and correct information. DHH will not be held accountable to verify the information provided.

By registering your personal information you agree to adhere to the Terms of Agreement and Service of DHH Platform.

Subscribers Registration Credentials

When registering, you are required to provide: Name, email address and create a password.
Upon registering you agree that you are not intentionally or unintentionally violating any applicable state or federal law regarding use of personal or Professional identifications’ information.

When registering:

  • You represent that the information you provide is true and correct.
  • The information must be accurate, true and correct.
  •  You must inform DHH as soon as possible of any changes or amendments to your personal or professional profile. You must update all changes on DHH Platform so your profile will remain updated.
  • DHH reserves the right to suspend and or cancel your registration at any time, should you misuse this Platform, break these terms of service or put DHH’s reputation, brand, operations including its website, blogs and discussion page or business including its partners and affiliates at risk.
  • The subscription will be billed monthly or annually as chosen by the subscriber.
  • DHH reserve the right to cancel your subscription if payment is not made on the monthly or yearly due date.

Linking Your Details To The Platform

Once you have subscribed and have an account and password with DHH Platform and its Service you will be granted permission from DHH to link your information on the Platform. We reserve the right to revoke such grant or consent to the link at any time at our sole discretion. If such consent is revoked, you agree to immediately remove and disable any content DHH deemed non-compliant with the Platform. If you do not comply with these rules in the Terms of Agreement and Service Your Subscription and account may be suspended, cancelled or completely and permanently removed from the DHH Platform and its Service.

Indemnification

You shall indemnify DHH in accordance with these Terms of Service for any liabilities, claims, damages, loss and expenses suffered by DHH arising from a breach of these Terms of Agreement and Service.

To the fullest extent permitted by applicable law, you agree to indemnify, hold harmless and defend DHH, our employees, contractors, officers, directors and other affiliated companies and suppliers, from all liabilities, claims, damages, loss and expenses, including attorney’s fees, that arise from your use or misuse of this Platform.

Limitation of Liability

Any use of any information from the Platform and its affiliates’ links or Services is at your own responsibility entirely. The Platform may contain inaccuracies or errors.

To the fullest extent permitted by applicable law, on behalf of DHH directors, offices, employees, agents, suppliers, licensors, affiliates and service providers, exclude and disclaim any and all liability for any losses and expenses however arising including, without limitation, any direct, indirect, compensation or consequential or exemplary damages arising from your use of or inability to use the Platform and Services. You assume total responsibility for using and or subscribing and establishing an account with the DHH Platform.

Relationship of the Parties

Dietitians are independent subscribers. This Terms of Agreement and service does not constitute and shall not be construed as constituting a partnership or joint venture, or an employee-employer relationship. You agree that DHH and its affiliates’ have no special relationship with or obligation to you. Neither party shall have any right, authority or power to enter into any agreement to otherwise bind, the other party, on behalf of, or incur any obligation or liability.

Governing Laws

By using the DHH platform you agree the law of the State of Queensland, Australia, governs these Terms of Agreement and Service and any claim or dispute, conflict or disagreement of any thought that may arise between you and DHH and their affiliates’.

You hereby expressly agreed to all the Terms of Agreement and Service for the purpose of resolving any dispute relating to these Terms of Agreement and Service and access to all use of the Platform and Service by you a Dietitian or/and all users.

Dietitians Responsibilities

Dietitians are responsible for all use of a Site and Services using their Credentials. Dietitians are responsible for keeping their passwords confidential and should notify DHH if their account has been hacked or changed in any way without their knowledge. DHH Platform is to be used lawfully in accordance with DHH terms of Agreement and service.

Ownership of Content

All of the Content available on or through the Platform Services and affiliates’ sites are owned by DHH and its Affiliates’ and is protected by copyright, trademark, patent and trade secret laws.

DHH Platform may also have security components that protect digital information. DHH allows Dietitians to use the content on its Platform. Dietitians may also print, download and store articles and other information for their convenience, but you must not distribute, republish (except as permitted in this paragraph), sell, mine, exploit, frame or scrape any of the Content, or exploit the Content.

Content You Submit On The Platform

You must comply with these Terms of Agreement and Service when you Subscribe and become a member of the Platform and its service.

You are solely responsible for any content and other material (“Content”) that you submit, publish or display on the Platform or transmit via the Platform to other members and/or other Platform users.
You must not falsely represent (expressly or implied) that such Content is sponsored or endorsed by DHH.

You must not post Content that is unlawful or that promotes or encourages illegal activity, including but not limited to anything, which would breach the Dietitians Australia’s code of practice or Accredited Practicing Dietitians code of practice, Therapeutic Goods Act 1989, Therapeutic Goods Regulations 1990, the Therapeutic Goods Advertising Code and/or the Competition and Consumer Act 2010 (including schedule 2: The Australian Consumer Law).

Posted content by Dietitians acceptance will be solely at the discretion of DHH. Content, which might be offensive, illegal, or may violate the rights of, harm or threaten the safety of other users or members of the Platform and/or other users. 

You must not post content that:

  • Is false, deceptive or misleading (or is likely to mislead or deceive);
  • Is patently offensive.
  • Messages that promote racism, bigotry, hatred or physical harm of any kind against any group or individual;
  • Harasses or advocates harassment of any kind about other Dietitians’ on the Platform.
  • Is Spamming of any kind
  • Violates publicity, privacy or other rights of other Users or the Platform itself and its affiliates’.
  • Promotes illegal activities.
  • Conduct in an abusive manner;
  • Testimonials are not to be non genuine, untruthful, non accurate;
  • Is threatening, obscene or defamatory;
  • Is sexually explicit in nature or misguided in nature.

DHH reserves the right to monitor and question all content posted or set up on the Platform.

You agree that you will only provide content that you believe to be true and accurate and you will not purposely provide false or misleading information.

About the Platform

DHH Platform contains a range of information for the benefits of health and wellbeing, which is made available to all Dietitians professionals. DHH does not endorse, accept or adopt the Dietitians practice with their clientele. 

DHH does not participate in the Dietitians professional practices with their respective clientele.

This Platform also contains a range of fact sheets prepared by DHH regarding a number of particular health conditions. This content is to be used as a general guide to health conditions. DHH Platform offers health information. The information on the Platforms is not intended to be or replace medical advice, diagnose, treat, cure or prevent any medical condition or for diagnosis and treatment.

Dietitians can use DHH media such as background cover photos only on the DHH Platform and explicitly not to be used on social media platforms, in print, marketing, emails other than displayed on DHH Platform

All Images, photos and background sceneries in the Gallery on DHH Platform are exclusive properties of DHH.

Invoices and Payments

When a client books a Dietitian they select a payment method whether it is Bulk Billing, Health Fund, NDIS participant or DVA cardholder. The consultation payment is an agreement between the patient and the Dietitian and not facilitated, monitored or resolved through DHH. Dietitian subscription to the DHH platform is non-refundable

Changes to Terms of Agreement Service

Terms of Service for this Platform may be changed at any time without prior notice. As a subscriber, you will be notified by email of updates.

Your continued use of a Site or Services constitutes your acceptance of and agrees to any revised Terms of agreement Service.

Revisions and or changes to the Terms of agreement Service may be notified on the Platform or via a generic email for subscribers. Revisions may be for a specified date or no effective date is specified. We encourage you to review the Terms of Service regularly.

Changes of Platform Services

DHH may add a new Service, revise an existing Service, or discontinue a Service. These changes relating to new Services and or changes will be notified on the Platform. Subscribers will automatically receive mail notifications. The Terms of Agreement and Services will govern these changes.

Other Links provided on DHH Platform

DHH Platform may include links to other websites. These links are provided for your convenience. DHH does not warrant these sites or the products and services they provide. DHH is not responsible or liable for the content and accuracy of these other sites.

Terms and Conditions of Other Websites

Our affiliates website links on the Platform may present policies or terms and conditions when you click on their links that will further govern your use of that particular Service. If you choose to register for or access any such Service, you will be presented with any relevant additional terms and conditions at that time. By using those Services, you agree to comply with the Terms and Conditions of that particular website.

Automated Tools

Use of any robot, spider, scraper and other automated tools to access the Platform and Services without explicated written permission from DHH is prohibited.

Competitions and Promotions

DHH and its affiliates’ may from time to time offer competitions and promotions on or via this Platform. Competitions and promotions shall be governed by specific rules with their own Terms of Conditions accessible from the pages offering the competition or promotion and will be presented to you at a promotional time. Subscribers may receive notifications relating to these competitions and promotions on the Platform or via email. You reserve the right to unsubscribe to such promotions.

Trademarks

A Trademark protects words or phrases and design elements that identify the source, owner or developer of a product or services.All trademarks on the Platform are exclusively the property of their respective owners, including and without limitation, DHH. No right, license or interest to such trademarks is granted by this Agreement.

Warranties

DHH present the Platform as is, with all faults and Current content. To the fullest extent permitted by applicable law, DHH, its affiliates and its suppliers make no express or implied warranty, guarantees or representation in respect of the information set in the Platform and Services, including but not limited to the completeness, currency, availability, reliability, suitability and/or accuracy of any information on the Platform. DHH will not guarantee results of the Platform to be effective, reliable, and accurate or meet your requirements.

Security

DHH takes reasonable steps to secure the Platform as set in the Privacy Policy. Dietitians must acknowledge risks with information sent to and from the Platform that may be modified, intercepted or corrupted by third parties. Moreover, Dietitians acknowledge a risk when downloading from the Platform, information may contain viruses, worms or other defects or nefarious devices.

DHH accepts no liability for any damages to or interference with your computer and device used while logged on to the Platform or visiting any of its affiliates links. Using the Platform and its services will be of your choosing and responsibility.

Termination

DHH reserve the right to suspend and or terminate your subscription/registration immediately, without notice, if there has been a violation of these Terms of Agreement and Service or other policies by someone using your Credentials.

DHH may also cancel or suspend your subscription/registration for any other reason, including if we are notified that you may have engaged in identity theft or fraud. DHH will attempt to notify you in advance of such cancellation or suspension. Your right to use the Services will end once your registration is cancelled or terminated.

By law, DHH may be required to retain your data for the purposes of informing the police in relation to identity theft or fraud or other illegal activities. Any data you have stored on the Platform may be unavailable later. You may terminate your registration at any time. We recommend that you transfer any records or other information stored on the Platform prior to terminating your subscription/registration.

Entire Agreement

Set herein, the Terms of Agreement and Service, policies, rules and guidelines posted on the Platform and/or the Services constitute the entire agreement between all users, DHH and its Affiliates’ supersede all previous written and or oral agreements. If any part of the Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

General

Where DHH and its Affiliates’ fail to exercise or enforce any rights or provision of the Terms of Agreement and Service does not constitute a waiver of such right or provision.

Should any provision of the Terms of Agreement and Service be found by a court of qualified authorities to be invalid, the parties agree, the court should try to give outcome to DHH intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.

Under this Terms of Agreement and Service without consent, DHH may assign any of its rights and obligations, including, in connection with any merger, consolidation, reorganisation, or sale of all or substantially all of its related assets or similar transaction.

The terms “including” and “includes” shall be deemed to be followed by the statement “without limitation” and neither of these terms shall be construed to limit any word or statement it follows to the specific or similar terms or matters immediately following it.

Neither DHH, Affiliates’, Dietitian or any User will be relying upon any warranties; representations, assurances or inducements not expressly set forth in this Terms of Agreement and Service.

DHH may provide you with notifications, regarding changes to this Agreement or any of the Terms of Agreement and Service of DHH, by email or postings on the Platform. Notice will be deemed given twenty-four (24) hours after such an email is sent or notice is posted.

This Agreement shall be binding on the parties’ permitted assignees, transferees and successors.

Electronic Contracting and Notices

DHH may send electronic Notices to the e-mail address that Customers/User or clients of/and the Dietitians’. By using the Platform and/or registering/Subscribing on the Platform and Services, you accept these Terms of Agreement and Service together with DHH Privacy Policy. You agree that DHH may send to you in electronic form any privacy or other notices, disclosures, reports, documents, communications or other records regarding the Platform and/or the Services and Notices.

DHH may send electronic Notices to the e-mail address that you, customer/User or clients and the Dietitians’ provided to us during registration. Alternatively, DHH may post the Notice on the applicable Service or otherwise through the Platform.

Notice will be deemed given twenty-four (24) hours after such email is sent or notice is posted. Customers/Users or clients of/ and the Dietitians’ can withdraw your consent to receive Notices electronically by cancelling or discontinuing your use of the applicable Service.

In order to receive Notices electronically, you must have a personal computer with a modem connected to a communications source (telephone, wireless or broadband), and a Windows-based operating system with an Internet browser or a Macintosh-based operating system with an Internet browser.

You will need a printer attached to your personal computer to print any Notices. You can retrieve an electronic copy and a printable version of this contract by clicking on the “Terms of Agreement and Service”, “Privacy Policy” or “Disclaimer” links on any pages of the Platform, which hosts any of these Services. All contracts completed electronically will be deemed for all legal purposes to be in writing and legally enforceable as signed writing.

REVIEWS

DHH End User” is a customer/User or clients of Dietitians, who is eligible to give Feedback on the Platform review sections of the Platform, in the form of ratings and reviews, as set out in these Terms of Agreement and Service.

“Feedback” refers to all kinds of content, including written and numeric ratings and reviews, provided by the User or clients of Dietitians to Collect Reviews as a result of a Feedback Request being sent to them following a transaction with the Dietitian.

“Feedback Request” refers to communication between Reviews collections and the User or clients of Dietitians inviting them to submit Feedback regarding a previous transaction between the customer/User or clients and the Dietitians’.

DHH encourage the customer/User or clients of the Dietitians to submit reviews of the Dietitians after a consultation.

Tips for writing great customer reviews

  1. Provide useful, constructive feedback.
  2. Talk about a range of elements, including customer service.
  3. Be detailed, specific, and honest.
  4. Leave out links and personal information.
  5. Keep it civil and friendly.
  6. Feel free to update your review if needed.
  7. Check you’ve got the right domain name or company.
  8. Proofread your review

Accredited Practicing Dietitians (APD)

All Dietitians must provide Accredited Practicing Dietitians (APD) credentials. APD displayed after their name and/or the APD logo displayed on their professional profile. If Dietitians do not provide an official APD logo on their professional profile, it may result in delaying or denying registration.

All members with Australian recognised dietetic qualifications and non-members with APD status to ensure that they will continue to be recognised by the public as the most valued and credible source of food and nutrition information shall adopt the Code of Professional Conduct.

The APD Credential

The APD credential is a public guarantee of nutrition and dietetic expertise. It is the only credential recognised by the Australian Government, Medicare, the Department of Veterans Affairs and most private health funds as the quality standard for nutrition and dietetics services in Australia.

Dietitians must have the letters APD after their name, or the official APD logo:

  • All Dietitians on DHH must confirm they have professional indemnity insurance.
  • Dietitians identities are verified via APD credential.
  • Dietitians must have permission from APD to affix the APD logo on their professional profile.
  • Responsible to manage their own tax.
  • DHH is not liable for payments to Dietitians, via Medicare, insurance providers or otherwise. It is a mutual agreement between the client and the Dietitians.

DHH does not require Dietitians to present their APD numbers. However, upon request, you may be asked to provide your APD number for legal verification.

Code of professional conduct

For members with Australian recognised dietetic qualifications, and non-members with APD status

(by-law made pursuant to clauses 9, 21, 36 of the constitution) revised march 2013

The Dietitians Association of Australia (DAA) is a self-regulatory professional body, which sets standards for practice, fosters professionalism and provides a mechanism for internal disciplinary procedures for the protection of members, the public and the credibility of the profession.

The code of professional conduct sets minimum national standards for accountable conduct, which promotes the health of the public and engenders confidence in the services provided by members and non-member accredited practising Dietitians.

Those subject to this code of practice shall adhere to the constitution, by-laws, rules of the association, and all laws of the commonwealth.

The attached statement of ethical practice provides the principles underpinning the code of professional conduct for the members of the association with Australian recognised dietetic qualifications, and non- members with APD status who are equally referred to as practitioners in this code.

1. Definition

Practice, for the purpose of this by-law, is considered in the broadest terms to cover any activity considered to be within the accepted scope of a Dietitians/ nutritionist’s work.

2. Criteria governing professional conduct.

There are two criteria under which the complaints and disciplinary process may be activated.

A) Unsatisfactory professional conduct

Defined as:

• Conduct ‘happening in connection with the practice of dietetics that falls short of the standard of competence and diligence that a member of the public or the practitioner’s peers is entitled to expect of a reasonably competent Dietitians/nutritionist’.

B) Professional misconduct

Defined as:

  • ‘Conduct, which involves a substantial or consistent failure to reach or maintain a reasonable standard of competence and diligence’; or
  • Conduct happening in connection with the practice of nutrition/ dietetics or otherwise that would, if established, justify a finding that the practitioner is not a fit and proper person to continue to be a member of the association and engage in nutrition and dietetic practice.

Professional misconduct may include being convicted of a criminal offence.

If a complaint has been made against a practitioner under the complaints and disciplinary procedure by-law, and that practitioner breaches the complaints and disciplinary procedure by-law by contacting, or attempting to contact either:

(a) A director of the DA board; or
(b) The person who made the complaint against them

In relation to the complaint then this may amount to professional misconduct.

3. Application of the code of professional conduct

It is the responsibility of each practitioner to evaluate practice and maintain competence as well as to evaluate the professional standards and contribute to the objects of the association.

The code of professional conduct shall be adopted by all members with Australian recognised dietetic qualifications, and non-members with APD status to ensure that they will continue to be recognised by the public as the most valued and credible source of food and nutrition information.

Practitioners have a responsibility to inform relevant organisations of violators of the DAA code of professional conduct and other laws.

The code of professional conduct is enforced by DAA under the complaints and disciplinary procedure by-law and reviewed from time to time.

The APD Credential
The APD credential is a public guarantee of nutrition and dietetic expertise. It is the only
credential recognised by the Australian Government, Medicare, the Department of Veterans
Affairs and most private health funds as the quality standard for nutrition and dietetics services
in Australia.
Dietitians or nutrition professional must have the letters APD after their name, or the APD logo:
• All Dietitians on DHH must confirm they have professional indemnity insurance.
• Dieticians identities are verified via APD credential.
• Dietitians must have permission from APD to affix the APD logo on their professional
profile.
• Responsible to manage their own tax.
• DHH is not liable for payments to Dietitians, via Medicare, insurance providers or
otherwise. It is a mutual agreement between the client and the Dietitians.
DHH does not require Dietitians to present their APD number. However, upon request you
may be asked to provide your APD number for legal verification.
DHH adheres to the guidelines and by-laws of Dietitians Australia.

Code of professional conduct
For members with Australian recognised dietetic qualifications, and non-members with APD
status
(by-law made pursuant to clauses 9, 21, 36 of the constitution) revised march 2013
The Dietitians association of Australia (DAA) is a self-regulatory professional body, which sets
standards for practice, fosters professionalism and provides a mechanism for internal disciplinary
procedures for the protection of members, the public and the credibility of the profession.
The code of professional conduct sets minimum national standards for accountable conduct,
which promotes the health of the public and engenders confidence in the services provided by
members and non-member accredited practising Dietitians.
Those subject to this code of practice shall adhere to the constitution, by-laws, rules of the
association, and all laws of the commonwealth.
The attached statement of ethical practice provides the principles underpinning the code of
professional conduct for the members of the association with Australian recognised dietetic
qualifications, and non- members with APD status who are equally referred to as practitioners in
this code.

    Practice, for the purpose of this by-law, is considered in the broadest terms to cover any activity
    considered to be within the accepted scope of a Dietitians/ nutritionist’s work.
  2. Criteria governing professional conduct.
    There are two criteria under which the complaints and disciplinary process may be activated.
    A) Unsatisfactory professional conduct
    Defined as:
    • Conduct ‘happening in connection with the practice of dietetics that falls short of the standard
    of competence and diligence that a member of the public or the practitioner’s peers is entitled to
    expect of a reasonably competent Dietitians/nutritionist’.
    B) Professional misconduct
    Defined as:
    • ‘Conduct, which involves a substantial or consistent failure to reach or maintain a
    reasonable standard of competence and diligence’; or
    • Conduct happening in connection with the practice of nutrition/ dietetics or otherwise
    that would, if established, justify a finding that the practitioner is not a fit and proper
    person to continue to be a member of the association and engage in nutrition and
    dietetic practice.
    Professional misconduct may include being convicted of a criminal offence.
    If a complaint has been made against a practitioner under the complaints and disciplinary
    procedure by-law, and that practitioner breaches the complaints and disciplinary procedure bylaw by contacting, or attempting to contact either:
    (a) A director of the DA board; or
    (b) The person who made the complaint against them
    In relation to the complaint then this may amount to professional misconduct.
  3. Application of the code of professional conduct
    It is the responsibility of each practitioner to evaluate practice and maintain competence as well
    as to evaluate the professional standards and contribute to the objects of the association.
    The code of professional conduct shall be adopted by all members with Australian recognised
    dietetic qualifications, and non-members with APD status to ensure that they will continue to be
    recognised by the public as the most valued and credible source of food and nutrition
    information.
    Practitioners have a responsibility to inform relevant organisations of violators of the DAA code
    of professional conduct and other laws.
    The code of professional conduct is enforced by DAA under the complaints and disciplinary
    procedure by-law and reviewed from time to time.

    The statement of ethical practice indicates to the community, values which practitioners hold.
    DAA encourages debate and discussion to keep practitioners abreast of contemporary issues.
    DAA also subscribes to the principles and aspirations of the universal declaration of human
    rights (1948) and other international conventions derived from the declaration.
